Terms and Conditions (T&C)
1. Scope and Provider
These Terms and Conditions apply to all contracts concluded through the online shop at berlindayz.de between the customer and the following provider:

2. Subject Matter of the Contract
The online shop exclusively offers time-limited Priority Queue access for the BERLIN DayZ PlayStation server.
Priority Queue means that players with active Priority access are placed ahead of players without Priority in the server queue. Priority does not guarantee immediate or uninterrupted access to the server. Waiting times may still occur, particularly when other players with Priority are also in the queue.
Depending on the selected option, the available durations are 31, 62, or 93 days.
3. Conclusion of the Contract
The presentation of Priority Queue offers in the online shop does not constitute a binding contractual offer. The customer selects the desired duration, enters the information required to place the order, and chooses one of the available payment methods.
Before completing the order, the customer has the opportunity to review and, if necessary, correct their entries.
The contract is concluded upon successful completion of the payment process.
4. Prices and Payment
All prices listed in the online shop are final prices in euros (€). In accordance with the small business regulation under Section 19 of the German VAT Act (UStG), VAT is not shown separately.
Payment can be made via PayPal or credit/debit card. The available payment methods are displayed during the checkout process.
All payments are one-time payments. No subscription is created, and there are no automatic paid renewals.
5. Start and Duration of Priority Access
The purchased Priority access period begins immediately upon successful completion of the purchase. Activation is automated and usually takes place within approximately 10 minutes after purchase.
Priority access automatically expires at the end of the purchased period. There is no automatic renewal.
If Priority access is purchased again for the same PSN account while an existing Priority period is still active, the newly purchased duration will be added to the remaining access period.
6. PlayStation-Network-Name
To activate Priority access, the correct PlayStation Network name (PSN name) of the account for which Priority is intended must be provided during checkout. The customer is responsible for entering the PSN name correctly.
Priority access can also be purchased for another person. In this case, the PSN name of the intended recipient must be provided during checkout.
A typo in the PSN name may prevent automatic activation or cause it to be processed incorrectly. In such cases, the customer should contact support. Obvious input errors may be corrected after review. Any voluntary compensation for access time lost due to a typo made by the customer is granted solely as a gesture of goodwill and does not establish any entitlement to similar extensions in future cases.
Intentionally providing a specific PSN name and later requesting to transfer Priority access to a different account does not constitute a typo.
7. Priority Access Linked to the PSN Account
Once activated, Priority access is linked to the PSN account specified during purchase. Transferring activated Priority access to another PSN account is generally not permitted. This does not affect the correction of genuine input errors in accordance with Section 6.
8. Activation Delays
If activation is delayed due to a technical or organizational error attributable to CTMLK, the Priority access period will be extended by the actual amount of access time lost as a result.
The customer's statutory rights in the event of failure to provide the service or defective provision of the service remain unaffected.
9. Server Availability, Maintenance, and Wipes
Priority access does not guarantee uninterrupted availability of the DayZ server. In particular, regular server restarts, scheduled maintenance, wipes, and technically necessary work may result in temporary interruptions.
Regular server restarts, wipes, and routine short-term maintenance or operational interruptions generally do not result in an extension of the Priority access period.
In the event of prolonged, unscheduled server outages, the Priority access period will be extended by a reasonable amount as compensation. The customer's statutory rights remain unaffected.
10. Server Rules and Bans for Rule Violations
The use of the BERLIN DayZ server is subject to the currently published server rules. The server rules are available for review before purchase at https://www.berlindayz.de/regeln/ .
If a player violates the applicable server rules, the measures specified in those rules may be imposed, up to and including a temporary or permanent ban from the server.
If a player is temporarily or permanently banned from the server due to a violation of the server rules for which they are responsible, any existing Priority access period will continue to run during the ban. The duration of the ban generally does not entitle the player to an extension of the Priority access period or a partial refund of the purchase price.
The customer's mandatory statutory rights remain unaffected.
11. Discontinuation or Restriction of Server Operations
If CTMLK permanently discontinues the BERLIN DayZ server, new Priority purchases will be suspended in good time, and existing Priority access periods will generally be allowed to expire before the server is permanently shut down.
In the event of restrictions or discontinuation of server operations due to circumstances beyond CTMLK's control, particularly decisions, technical changes, or the discontinuation of services by Bohemia Interactive, the server hosting provider, or other third-party providers necessary for server operations, the applicable statutory provisions shall apply.
The customer's mandatory statutory rights, particularly in cases where the agreed service can no longer be provided, remain unaffected.
12. Right of Withdrawal
Consumers are entitled to the statutory right of withdrawal in accordance with applicable legal provisions. Further details can be found in the separate Withdrawal Policy available in the online shop.
13. Defects and Statutory Rights
The statutory rights applicable in cases of non-conforming, defective, or failure to provide the agreed service shall apply.
The voluntary goodwill arrangements described in these Terms and Conditions do not limit the customer's statutory rights.
14. Liability
CTMLK shall be liable without limitation for damages resulting from injury to life, body, or health, as well as for damages caused by intent or gross negligence.
In the event of a slightly negligent breach of essential contractual obligations, liability shall be limited to the foreseeable damages typical for the contract, to the extent permitted by law. Essential contractual obligations are those whose fulfillment is necessary for the proper performance of the contract and upon whose compliance the customer may reasonably rely.
Mandatory statutory liability provisions remain unaffected.
15. Applicable Law
The laws of the Federal Republic of Germany shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
If the customer is a consumer and habitually resides in another country, the mandatory consumer protection provisions of the country of their habitual residence shall remain unaffected, insofar as these cannot be excluded by a choice of law under the applicable legal provisions.
16. Consumer Dispute Resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
17. Final Provisions
If any provision of these Terms and Conditions is or becomes invalid, the applicable statutory provisions shall apply in its place. The validity of the remaining provisions shall remain unaffected.
